Exceptional Hardship

When a driving ban is imposed when 12 points have accumulated on someone’s licence, a common option for mitigating circumstances is Exceptional Hardship. If this defence is successful, it means that a driving ban will not be imposed. The Court gives individuals the opportunity to plea the exceptional hardship argument, where it is for the Defendant to prove that hardship would be much more than the hardship ordinarily suffered by the average man. It is for the defendant to prove the severity of the hardship that would be caused if a driving ban would be imposed.
